Father arrested after 2-year-old son was swept away by floodwaters in Barstow last month
BARSTOW, CA — A month-long investigation into a heart-wrenching tragedy has culminated in criminal charges against a father, who prosecutors allege acted with gross negligence leading to the death of his two-year-old autistic son, who was swept away by floodwaters last month.
The shocking case has ignited fury as details emerge of the alleged recklessness that cost the life of little Xavier Padilla-Aguilera.
The incident occurred on September 18, when heavy rains turned a Barstow street into a dangerous torrent. Despite the clear and imminent danger, Xavier’s father, Brandon Padilla-Aguilera, 26, allegedly drove his vehicle into a flooded area of Main Street. Their car was immediately swept into a raging wash, separating the toddler from his father.
While dozens of emergency responders and community volunteers frantically searched for the missing nonverbal child for over 20 agonizing hours, Padilla-Aguilera was found rescued on a small island, treated, and released. The search ended in tragedy the following day when Xavier’s body was discovered in a flood control channel.
The San Bernardino County District Attorney’s Office has since filed damning charges against the father: Vehicular Manslaughter with Gross Negligence and Child Abuse under Circumstances Likely to Cause Great Bodily Injury or Death.
